Welcome to annuck.com. Here you’ll find the terms and conditions governing purchases made through this website. By placing an order, you agree to these terms, so please read them before ordering 🩷
1. Who you’re buying from
annuck.com is operated by Annuck di Battistin Anna, a sole proprietorship based at Via B. Camonico 6, 36061 Bassano del Grappa (VI), Italy, VAT number IT04566430247, registered with the Vicenza Companies Register under REA no. VI-413580. Email: sillymail@annuck.com.
2. Who these terms apply to
2.1 These terms apply to all orders placed on annuck.com by consumers, meaning individuals purchasing for purposes unrelated to their professional or business activity.
2.2 To place an order, you must be at least 18 years old, or act with the consent of a person exercising parental responsibility.
2.3 The version of these terms published on the website at the time you place your order always applies. The contract is concluded in Italian; the English translation is provided for convenience only, and in the event of any discrepancy, the Italian version shall prevail, without prejudice to any mandatory protections provided by applicable law.
3. The products
3.1 Everything is handmade, one piece at a time. Each product may therefore have small variations in shape, colour and finish compared to the photos. These are not defects, but rather a characteristic of a handmade item.
3.2 Colours may appear differently depending on the screen you are using.
3.3 Available quantities are limited and may sell out quickly. I reserve the right to change the product range, prices and availability at any time, without affecting orders that have already been accepted.
4. Safety warning
4.1 My products are decorative and collectible items intended for an adult audience. They are not toys and are not suitable for children under 14 years of age.
4.2 They contain small parts that may pose a choking hazard. Keep them out of the reach of children and pets.
4.3 They are intended for display purposes and not to be handled as toys. They are not suitable for contact with food or for use in humid environments or outdoors, unless otherwise stated in the product description.
5. Prices and taxes
5.1 Prices are shown on each product page and include all applicable taxes. They do not include shipping costs, which are calculated at checkout based on the destination.
5.2 I operate under the Italian regime forfettario (flat-rate tax regime): sales are made without VAT being charged pursuant to Article 1, paragraphs 54 to 89, of Law No. 190/2014. I therefore cannot issue invoices showing VAT or process requests for VAT deduction.
5.3 For each order, I issue the relevant fiscal document, which is not sent automatically. You can request a copy by emailing me at sillymail@annuck.com.
5.4 If you are purchasing from a country where the website displays prices in your local currency, the amount is automatically converted and includes a currency conversion fee. The amount actually charged by your bank may differ slightly due to the exchange rate applied and any fees charged by your bank or payment provider.
5.5 Orders shipped outside the European Union may be subject to customs duties and import taxes. You can find further details in the Shipping Policy.
6. How the contract is concluded
6.1 Before confirming your order, you can review the order summary and correct any information you have entered by going back through the checkout pages. The final button clearly indicates that placing the order creates an obligation to pay.
6.2 Submitting an order constitutes an offer to purchase. The automated email you receive immediately afterwards only confirms that your order has been received; it does not yet constitute acceptance of the order.
6.3 The contract is concluded when I send you the shipping confirmation, or otherwise expressly accept your order.
6.4 I may refuse to accept an order if the product is no longer available, if the price or description contained an obvious and recognisable error, if the destination address is not served, if payment is unsuccessful, or if there are reasonable grounds to suspect fraud or a purchase intended for resale. In such cases, I will notify you by email and issue a full refund promptly.
6.5 I keep a copy of received orders. You may request a copy by emailing me at sillymail@annuck.com.
7. Payment methods
7.1 The accepted payment methods are shown at checkout and at the bottom of the website.
7.2 Payment details are processed directly by the relevant payment service providers: they do not pass through me and I do not store them.
8. Shipping
8.1 Destinations, costs, delivery times and the handling of lost or damaged packages are governed by the Shipping Policy, which forms an integral part of these terms.
9. Right of withdrawal
9.1 You have 14 days from receipt of your order to exercise your right of withdrawal without having to give a reason. The procedures, refund timescales and return shipping costs are described in the Return and Refund Policy.
9.2 The right of withdrawal does not apply to products made to your specifications or clearly personalised at your request, pursuant to Article 59(1)(c) of the Italian Consumer Code. Products subject to this exception are clearly identified as such on the product page before purchase.
10. Legal guarantee of conformity
10.1 All products are covered by the legal guarantee of conformity provided for by Articles 128 et seq. of the Italian Consumer Code. If a product is defective or does not conform to what was ordered, you are entitled to have the product brought into conformity within two years of delivery, at no cost to you.
10.2 To exercise this right, email me at sillymail@annuck.com and attach a few photos. We’ll find the quickest solution together, whether that means repair, replacement, a price reduction or a refund, in accordance with applicable law.
10.3 The guarantee does not cover damage resulting from improper use, impacts, falls, modifications or normal wear and tear, nor the handmade variations described in Section 3.1.
11. Intellectual property
11.1 All content on annuck.com, including text, photographs, illustrations, graphics, the Annuck brand and product designs, is my property and protected by copyright and industrial property laws.
11.2 Purchasing a product gives you ownership of the physical item, not the rights to its design. You may not reproduce, copy, trace, create moulds from, digitise or manufacture derivative items based on my products, nor use my images or texts for commercial purposes.
11.3 You may share photos of my products on your personal channels, provided you credit the source.
11.4 If you tag me or send me photos of the products you receive, I may reshare them on my channels and credit you. If you would prefer me not to do so, simply let me know and I won’t.
12. Use of the website
12.1 You agree not to use the website for unlawful activities, attempt unauthorised access, automatically extract content or interfere with the operation of the service.
12.2 In the event of improper use or abusive behaviour, I may restrict or suspend access to the website and refuse future orders.
13. Liability
13.1 To the extent permitted by law, I am not liable for damage resulting from use of the products other than for their intended decorative and collectible purposes, or from failure to comply with the safety warnings in Section 4.
13.2 I do my best to ensure that the website operates correctly, but I cannot guarantee that it will always be available and free from interruptions. To the extent permitted by law, I am not liable for indirect damages arising from malfunctions or temporary unavailability.
13.3 Nothing in these terms limits or excludes my liability for death or personal injury, fraud or gross negligence, damage caused by a defective product, or your rights under the legal guarantee of conformity and any other mandatory consumer protection laws.
14. Force majeure
14.1 I am not liable for delays or failures to perform caused by circumstances beyond my reasonable control, such as natural disasters, public health emergencies, strikes, or disruptions to transport or customs services. In such cases, I will notify you as soon as reasonably possible and, if the delay continues beyond a reasonable period, you may terminate the contract and receive a full refund of the amount paid.
15. Promotions, subscriptions and programmes
15.1 Discounts, promotional codes, giveaways and loyalty programmes are governed by the specific terms published from time to time.
15.2 Subscriptions, including the Silly Pond Club, are governed by their own dedicated terms, which take precedence over these terms with regard to duration, renewal and cancellation.
16. Personal data
16.1 The processing of your personal data is described in the Privacy Policy.
17. Changes to these terms
17.1 I may update these terms to reflect changes in legislation or changes to my business. The updated version will be published on this page together with the date of the latest update.
17.2 Changes will not apply retroactively: orders already placed are always governed by the version of the terms in force at the time the order was submitted.
18. Applicable law and disputes
18.1 These terms are governed by Italian law. If you are habitually resident in another country, this choice of law does not deprive you of the mandatory protections provided by the laws of your country of residence.
18.2 For any dispute, jurisdiction lies with the court of the consumer’s place of residence or domicile, if located in Italy.
18.3 Before taking legal action, you can contact me at sillymail@annuck.com: I will always try to resolve the matter directly. Alternatively, you may use the alternative dispute resolution (ADR) bodies provided for by the Italian Consumer Code. If you purchase from another European Union country, you may contact the European Consumer Centres Network.
